Federal Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Custody

A court has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement lacks legal authority.

"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.

The case stems from a mistaken removal to El Salvador in March, which US authorities later admitted was an error. After his repatriation to the United States to face alien smuggling charges, he was detained in immigration custody.

In her decision, the judge noted that the government lacks a current removal order, which prevents them from removing Mr. Abrego Garcia "at this time."

Context of the Legal Challenge

The legal proceedings involve conflicting claims. While the former administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this claim.

He has also entered a not guilty plea to the smuggling counts, which are part of a separate trial in Tennessee.

The judge, who was hearing his challenge to deportation in a federal court, determined that he must now adhere to the conditions of his release from custody in Tennessee. This decision shifts his supervision to the Tennessee court.
